Welcome to EmergencyMusician LLC (“EmergencyMusician,” “EM,” “we,” “us,” or “our”).
By accessing or using the EmergencyMusician platform (including our website, mobile app, and related services) you agree to these Terms and Conditions (“Terms”). If you do not agree, please do not use the platform.
1. About EmergencyMusician
EmergencyMusician connects churches, event organizers, and other clients (“Customers”) with qualified, vetted musicians (“Musicians”) for live events, church services, and other bookings.
We provide a technology platform that facilitates connections, payments, and scheduling — we are not a direct employer of musicians.
2. Eligibility
To use EmergencyMusician, you must:

Be at least 18 years old or have legal guardian consent.

Create an account with accurate, up-to-date information.

Comply with all local laws and tax obligations related to your use of the platform.
We reserve the right to approve, deny, or terminate any user account at our discretion.
3. Account Registration
By creating an account, you agree to:

Provide complete and accurate information.

Keep your login credentials secure.

Notify us immediately if you suspect unauthorized access to your account.
Each account is for individual use only and may not be shared or transferred without our written consent.
4. Communication and Opt-In Consent
By creating an account on EmergencyMusician, you consent to receive SMS messages, emails, or in-app notificationsabout:

Booking updates, confirmations, and cancellations

Account activity or support follow-ups
-
Service alerts or policy updates
-
(Optional) Marketing or promotional messages if you’ve chosen to receive them
Message frequency may vary. Message and data rates may apply.
You can reply STOP at any time to stop receiving text messages or use unsubscribe links in emails.
5. Platform Role and Disclaimer
EmergencyMusician is a marketplace, not an employer.
We do not guarantee performance, attendance, or outcomes of any booking.
Musicians are independent contractors responsible for their own behavior, taxes, insurance, and compliance with applicable laws.
We facilitate payments, scheduling, and communication but are not a party to the agreement between Customer and Musician.
6. Bookings and Payments

Customers can request or post gigs through the app or web portal.

Musicians can apply (“bid”) or accept available gigs.

All bookings, payments, and cancellations must be processed through EmergencyMusician.

Payments are held securely until the service is completed, then released to the Musician minus applicable service fees.
EM may charge service fees to both Customers and Musicians, which will be clearly shown before confirming a booking.
7. Cancellations
a. Customer Cancellations:
If a Customer cancels after confirming a booking:

Cancellations within 24 hours of the event may result in full or partial charge.

Cancellation fees may be distributed to the Musician per EM’s policies.
b. Musician Cancellations:
If a Musician cancels a confirmed gig:

It may affect their rating and future eligibility on the platform.
-
Repeated cancellations may result in suspension or removal from EM.
EmergencyMusician reserves the right to step in to assist both parties in case of disputes or emergencies.
8. Buyouts and Long-Term Hires
If a Customer wishes to hire a Musician directly outside of the EM platform (for ongoing or full-time work), a buyout fee applies to protect the integrity of our network.
Buyout Fee:
$600 + 50% of the Musician’s highest total earnings on EM in the past 12 months.
By using EM, both Musicians and Customers agree not to bypass the platform to avoid fees.
9. Loyalty & Referral Programs
EmergencyMusician may offer loyalty points or rewards for:

Completing gigs (for Musicians)

Hiring multiple musicians or frequent bookings (for Customers) These programs are discretionary and may change or be discontinued at any time.
10. Ratings and Reviews
After each gig, Customers and Musicians may rate each other.
Ratings are used for quality control and transparency.
You agree to provide fair, honest feedback and understand that EM may remove false or defamatory reviews.
11. Fees and Taxes

EM fees are non-refundable unless otherwise stated.

Musicians are independent contractors and are responsible for reporting and paying their own taxes.

EM may provide annual earnings summaries or 1099 forms when required by law.
12. Prohibited Conduct
You agree not to:

Use EM for any illegal or fraudulent purpose.

Circumvent the EM platform for off-platform payments.
-
Post false information, impersonate others, or misuse another user’s account.

Harass, threaten, or discriminate against others.
Violations may result in account suspension, termination, or legal action.
13. Dispute Resolution
EmergencyMusician is not responsible for disputes between Customers and Musicians.
However, we may mediate in good faith where possible.
All disputes arising from these Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
Venue for any legal action shall be in Orange County, Florida.
14. Limitation of Liability
To the fullest extent permitted by law:

EmergencyMusician is not liable for any indirect, incidental, or consequential damages.

We make no guarantees of bookings, income, or event outcomes.

Our total liability in any case shall not exceed the total fees you paid to EM in the preceding 12 months.
15. Intellectual Property
All EM content, branding, trademarks, and software are owned by EmergencyMusician LLC and protected by intellectual property laws.
Users may not copy, modify, or distribute any EM content without written permission.
16. Privacy
Your use of EmergencyMusician is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
17. Account Termination
We may suspend or terminate your account if you:

Violate these Terms

Engage in fraud or misconduct

Fail to comply with platform policies
You may also close your account at any time by contacting support.
18. Changes to These Terms
We may update these Terms from time to time.
Changes take effect immediately upon posting.
We encourage users to review the Terms periodically. Continued use of EM means you accept the updated version.
