EmergencyMusician’s Terms of Service.
The Client has booked the services of a Musician working for the company via the company’s website to provide Musical Services. CLIENT MUST USE REQUEST LINK to find & hire musicians for their services.
Failure to use REQUEST LINK will result in termination of services.
In the event client fails to make payment to company promptly as at when due, Client shall be liable to pay $2 as penalty for each day that Client fails to make the payment calculated from the date of receipt of the invoice by Client.
If a booking is canceled less than 5 hours before the booking start time, the Client shall not be refunded. However, if professionals fail to attend the event or arrive late for the show, the company shall refund the Client in full. This shall be determined on a case by case.
Client agrees that during the term of this agreement and for a period of 1 Year (1) after the termination or conclusion of Services, Client will not directly or indirectly:
Client acknowledges and agrees that any breach of any of the terms of this agreement will result in unquantifiable, irreparable loss and damage to the company. Client shall be liable to pay a fine of $400 to company for such breach.
IN NO EVENT WILL EMERGENCYMUSICIAN, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, MUSICIANS, HEROES, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CAN NOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
